Welcome to Open Fitness Network, Inc. (“OFN”, “we”, “our”, or “us”). These Terms of Use (“Terms”) form a legally binding agreement between you and OFN governing your use of our websites, mobile apps, community features, classes, and all related services (“Services”). By accessing or using any OFN Services, you agree to be bound by these Terms.
1. Age and Eligibility
You must be at least 18 years old to register or use the Services, or 13 years old with the supervision and permission of a parent or legal guardian.
2. Health Disclaimer
OFN is not a medical provider. The content we provide is intended for general educational and motivational purposes only and is not a substitute for medical advice. Consult a physician before starting any fitness or nutrition program.
3. Account Registration and Security
- You must provide accurate, complete, and updated information when creating an account.
- You are responsible for all activity under your account. Keep your login credentials secure and notify us immediately of any unauthorized access.
4. User Conduct
By using our Services, you agree not to:
- Violate any laws or regulations
- Upload or transmit harmful or inappropriate content
- Misrepresent your identity or impersonate another person
- Use the platform for commercial purposes without express written permission
5. Intellectual Property
All content on OFN, including videos, graphics, logos, text, and software is owned or licensed by OFN and protected by copyright, trademark, and other laws. You may only use the content for personal, non-commercial purposes unless otherwise agreed in writing.
6. User Submissions
By posting or uploading content to the platform, you grant OFN a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your content in connection with the Services. You represent that you own or have the rights to share any content you upload.
7. Payment, Subscriptions, and Refunds
Access to certain Services may require a paid subscription. By subscribing, you authorize recurring charges unless you cancel. Refunds may be available according to our Refund Policy.
8. Modifications to Services
We reserve the right to modify or discontinue any part of the Services at any time without notice. We are not liable for any modification, suspension, or discontinuation.
9. Termination
We may terminate or suspend your account and access to Services at our discretion, with or without cause, and without liability.
10. Disclaimer of Warranties
All OFN Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee results from use of the Services or warrant that content is accurate or error-free.
11. Limitation of Liability
To the fullest extent allowed by law, OFN and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, even if we have been advised of the possibility of such damages. In no event shall OFN’s total liability exceed the greater of $100 USD or the amount paid by you for Services in the last 6 months.
12. Arbitration and Dispute Resolution
Any disputes arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration unless otherwise prohibited by applicable law. You waive any right to participate in class actions or jury trials. See our Arbitration Agreement for more details.
13. Governing Law
These Terms are governed by the laws of the State of Florida, USA. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Orlando, Florida.
14. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes. Your continued use of the Services after changes become effective means you agree to the revised Terms.
